Terms of Service
By accessing or using D-Pass, you agree to be bound by these Terms of Service. If you do not agree, you must not use the platform. These terms form a binding legal agreement between you (or your organisation) and AI Group LTD.
1. Service Description
D-Pass is a Software-as-a-Service platform that enables manufacturers and organisations to create, manage, validate, and publish EU Digital Product Passports (DPPs) in compliance with EU ESPR (Regulation (EU) 2024/1781) and sector-specific regulations including the EU Battery Regulation 2023/1542.
We also offer a self-hosted deployment option under a separate licence agreement.
2. Account & User Responsibilities
- ▸ You are responsible for the accuracy and completeness of all DPP data you enter into the platform.
- ▸ You must keep your account credentials secure. You are responsible for all activity under your account.
- ▸ You must not use D-Pass to publish false, misleading, or fraudulent product data.
- ▸ You must not attempt to circumvent or reverse-engineer the compliance validation engine.
- ▸ Administrators are responsible for managing user access levels (RBAC) within their tenant.
3. Subscription & Billing
- ▸ A live demo environment is available at demo.d-pass.eu — no account or credit card required.
- ▸ Paid subscriptions begin upon activation of a plan. They auto-renew monthly or annually unless cancelled before the renewal date.
- ▸ Prices are shown excluding VAT. VAT applies per EU Directive 2006/112/EC based on your billing country.
- ▸ Refunds are issued at our discretion within 14 days of a charge if the service was not usable due to a platform fault.
- ▸ Downgrading your plan takes effect at the next billing cycle.
4. Data Ownership
You retain full ownership of all DPP data and product information you enter into the platform. AI Group LTD claims no ownership or intellectual property rights over your data.
We process your data solely to provide the service as described in our Privacy Policy. Upon account termination, you may export your data in JSON-LD format. Data is permanently deleted 90 days after account closure.
5. Service Availability & SLA
- ▸ Starter/Growth plans: We target 99.5% monthly uptime. Scheduled maintenance is announced at least 48 hours in advance.
- ▸ Enterprise plan: 99.9% uptime SLA with service credits for breaches, governed by a separate SLA agreement.
- ▸ We reserve the right to suspend accounts that violate these Terms with immediate effect.

7. Limitation of Liability
To the maximum extent permitted by applicable law:
- ▸ Our total liability in any 12-month period is capped at the subscription fees you paid during that period.
- ▸ We are not liable for indirect, consequential, or incidental damages.
- ▸ We are not liable for regulatory penalties arising from DPPs you published.
8. Intellectual Property
D-Pass, its logo, platform code, and documentation are the property of AI Group LTD and are protected by copyright and trademark law. You may not copy, modify, or redistribute the platform without written permission.
9. Governing Law & Disputes
These Terms are governed by the laws of the Republic of Bulgaria. Any dispute arising from or relating to these Terms shall first be attempted to be resolved amicably. Unresolved disputes shall be submitted to the competent courts of Sofia, Bulgaria.
For consumer disputes within the EU, the European Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr.
10. Changes to These Terms
We may modify these Terms. We will provide at least 30 days' notice for material changes via email to registered account holders. Continued use of the platform after the notice period constitutes acceptance of the revised Terms.
